These Terms of Service (“Terms”) govern your use of the Don’t Panic mobile application (“App”) published by GAME TRAIL LABS, LLC (“we,” “us,” or “our”). By downloading, installing, or using the App you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using the App you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. We may update these Terms from time to time. Material changes will be communicated through the App or by updating the “Last Updated” date above. Continued use after changes constitutes acceptance of the revised Terms.

2. Description of Service

Don’t Panic is a general-wellness application that provides self-help tools informed by cognitive behavioral therapy (CBT) and mindfulness research. Features include:

  • An 8-phase guided panic relief system
  • Breathing exercises with visual and haptic guidance
  • Grounding techniques
  • Guided meditations
  • Educational lessons on panic and anxiety
  • Guided journaling with mood tracking
  • Goal setting and progress analytics
  • Calming games and trivia
  • Affirmations and panic facts
  • Exposure hierarchy (Fear Ladder) tracker
  • Apple Watch companion app

Feature availability depends on whether you are using the free tier or a premium subscription.

3. Medical Disclaimer

IMPORTANT: Don’t Panic is NOT a medical device. It is NOT intended to diagnose, treat, cure, or prevent any disease, disorder, or medical condition, including but not limited to panic disorder, generalized anxiety disorder, or any other mental health condition.

The App is designed for general wellness and self-help purposes only. The content within the App—including lessons, exercises, and meditations—is educational and informational. It is not a substitute for professional medical advice, diagnosis, or treatment from a licensed physician, psychiatrist, psychologist, or other qualified healthcare provider.

If you are experiencing a medical or psychiatric emergency, call 911 (US), 999 (UK), 112 (EU), or your local emergency number immediately. If you are in crisis, contact the 988 Suicide & Crisis Lifeline (call or text 988) or the Crisis Text Line (text HOME to 741741).

Never disregard professional medical advice, delay seeking treatment, or discontinue prescribed medication because of something you have read or experienced in this App. Your use of the App does not create a therapist-patient or doctor-patient relationship.

4. Eligibility

You must be at least 13 years old to use this App. If you are between 13 and 17, you must have the permission of a parent or legal guardian. By using the App you represent and warrant that you meet these requirements. We do not knowingly collect personal information from children under 13 (see our Privacy Policy).

5. Account and Data

The App does not require account creation or registration. Your data is stored locally on your device using iOS secure storage. If you choose to enable iCloud sync, your data is additionally stored in your personal iCloud account under your Apple ID. You are responsible for maintaining the security of your device and iCloud account.

6. Subscriptions and Payments

6.1 Free Features

The following features are available for free, without a subscription or trial, and will remain free indefinitely:

  • Full 8-phase Panic Button system
  • 2 breathing exercises (Box Breathing, 4-7-8 Breathing)
  • 2 grounding techniques (5-4-3-2-1 Technique, Ice Cube Technique)
  • 3 recovery lessons
  • 25 panic facts
  • 1 calming game (Intrusive Thoughts)
  • Progress tracking

6.2 Free Trial

New users receive a 14-day free trial that unlocks all premium features. The trial begins automatically when you first open the App. The trial is local to your device and is not an App Store subscription trial. No payment information is required to start the trial. After 14 days, premium features revert to locked status unless you subscribe.

6.3 Premium Subscription

The App offers two auto-renewing subscription options through Apple’s App Store:

  • Monthly: $6.99 USD per month
  • Annual: $49.99 USD per year

Prices are in US dollars. Actual charges may vary by region based on exchange rates and local App Store pricing. We reserve the right to change pricing; existing subscribers will be notified before any price change takes effect on their next renewal.

6.4 Payment and Renewal

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate. We do not have access to your payment details; all billing is handled by Apple.

6.5 Managing and Canceling

You can manage or cancel your subscription at any time through Settings > [Your Name] > Subscriptions on your iPhone. Cancellation takes effect at the end of the current billing period—you retain premium access until then. Deleting the App does not cancel your subscription.

6.6 Refunds

Refunds are handled by Apple in accordance with Apple’s refund policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

7. User Content

You retain full ownership of all content you create within the App, including journal entries, goals, notes, and any exported data. We do not access, read, review, or use your personal content for any purpose. Your content is stored on your device and, if you enable iCloud sync, in your personal iCloud account—neither of which we have access to.

8. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Copy, modify, distribute, sell, lease, or sublicense the App or its content
  • Use the App in any way that could damage, disable, or impair its functionality
  • Present yourself as a medical professional or use the App to provide clinical advice to others
  • Remove or alter any proprietary notices, labels, or marks in the App

9. Intellectual Property

The App and all its content—including but not limited to design, graphics, text, audio, animations, lesson content, meditation scripts, and software code—are the property of GAME TRAIL LABS, LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

10. Third-Party Services

The App may integrate with the following third-party services:

  • Apple HealthKit: With your explicit permission, the App may write mindful minutes to HealthKit. HealthKit data is never shared with third parties or used for advertising.
  • Apple iCloud: If you enable sync, your data is stored in your personal iCloud account. We have no access to this data.
  • Apple StoreKit: Used to process subscription purchases through the App Store.

Your use of these services is subject to Apple’s terms and privacy policies. We are not responsible for the operation or policies of third-party services.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING THE EFFECTIVENESS, ACCURACY, OR RELIABILITY OF ANY TECHNIQUES, EXERCISES, OR CONTENT PROVIDED IN THE APP, OR REGARDING YOUR PERSONAL OUTCOMES FROM USING THE APP.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAME TRAIL LABS, LLC, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, EMOTIONAL DISTRESS, PERSONAL INJURY, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID US FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY DOLLARS ($50 USD).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless GAME TRAIL LABS, LLC and its affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney’s fees) arising out of or relating to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you create or share through the App.

14. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 3, 7, 9, 11, 12, 13, 16, and 17 shall survive termination.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith informal negotiation. If informal resolution is unsuccessful within thirty (30) days, either party may initiate binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall take place in Texas, or remotely at the election of the claimant.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, the entirety of this arbitration provision shall be void.

Exceptions: Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

17. General Provisions

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.

Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

18. Apple-Specific Terms

If you downloaded the App from Apple’s App Store, the following additional terms apply:

  • These Terms are between you and GAME TRAIL LABS, LLC, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide maintenance or support for the App.
  • In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
  • Apple is not responsible for addressing any claims relating to the App, including product liability, regulatory compliance, or intellectual property infringement.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
